18cmパウンド型
・バター 100g
・きび砂糖orグラニュー糖 70g
・はちみつ 15g
・塩 ちょっぴり
・卵黄 2個
・全卵 1個
・薄力粉 60g
・アーモンドパウダー 30g
・ベーキングパウダー 2g
・栗の渋皮煮 8個
・ラム酒 適量

【準備】
・バターを室温で柔らかくする
・パウンド型に敷き紙を敷く
・栗の渋皮煮の表面のシロップをペーパーで拭っておく
・薄力粉、アーモンドパウダー、ベーキングパウダーはふるって使う
・オーブンを170℃に予熱する

【作り方】
1. ボウルに柔らかくしたバター100gをほぐし、泡立て器で砂糖70gをすり混ぜ、はちみつ15g・塩ちょっぴりも混ぜる
2. 卵黄2個を1個ずつ混ぜ、溶いた卵1個分も少しずつ加えて混ぜ合わせる
3. 薄力粉60g・アーモンドパウダー30g・ベーキングパウダー2gをふるい入れ、ヘラに持ちかえてさっくり混ぜ合わせる
4. 粉っぽさがなくなってツヤが出たら半分を敷き紙を敷いたパウンド型に詰め、栗の渋皮煮を並べる
5. 残りの生地を詰めて表面を均し、170℃に予熱したオーブンで40~45分、竹串をさして生地がついてこなくなれば焼き上がり
6. 粗熱が取れたら取り出し、お好みの量のラム酒を刷毛で塗り、ラップに包んで馴染ませて出来上がり

[Ingredients]
18 cm pound cake mold

[Preparation]
・soften butter at room temperature
・Cover the pound cake mold with baking paper.
・Wipe the syrup on the inner skin of the chestnut with a paper towel.
・Sift weak flour, almond powder and baking powder.
・Preheat the oven to 170 °C.

[How to make]
1. Loosen 100 g of softened butter in a bowl, grind and mix 70 g of sugar with a whisk, and mix 15 g of honey and a bit of salt.
2. Mix 2 egg yolks one by one. Add 1 beaten egg little by little and mix.
3. Sift in 60 g of weak flour, 30 g of almond powder and 2 g of baking powder, and lightly mix it together with a spatula.
4. When the powdery feel is gone and the gloss comes out, cover half and stuff it in a pound cake mold covered with paper. Arrange the chestnuts simmered in their inner skins.
5. Stuff the rest of the dough and flatten the surface. Poke it with a bamboo skewer and bake it for 40 to 45 minutes in an oven preheated to 170 °C if the dough doesn't stick then it will be complete.
6. Take it out when it cools down. Brush it with your favorite amount of rum. Wrap it in a plastic wrap and it will be complete.

本研究旨在了解諮商督導者經驗平行歷程的經驗,借以理解諮商督導者知覺平行歷程之脈絡,以及督導者有無意識與辨悉平行歷程,並從督導者有意識和辨悉平行歷程的經驗文本中,找出督導者決定介入平行歷程的內在意圖與行動,進而發現後續影響的價值。 基於上述目的,本研究採用現象學取向之質性研究法,以立意取樣的方式,邀請八位諮商督導者,以半結構的訪談大綱進行個別深度訪談,共計蒐集有16組督導三人關係之平行歷程經驗,並依據現象學資料分析步驟進行分析與統整。 研究結果發現:1. 督導者知覺平行歷程之當下事件與脈絡:(1)督導者起初在面對平行歷程現象時,最先感受到的是諮商情境與督導情境中的騷

動;(2)騷動之情緒張力來自於諮商關係、督導關係、督導三人關係,或甚至是整個系統的彼此誘發;(3)情緒張力若持續,將使諮商與督導工作陷入膠著、難以發揮功能;(4)若督導者可以探尋工作膠著的源頭,將開啟對騷動的理解與平行歷程的意識;反之,倘若督導者未能對督導三人關係動力有更多的覺察,將維持著原有無效的督導介入,陷入督導困境。2. 督導者對平行歷程的意識與辨悉歷程:(1)因未有覺察,而維持原有無效的督導介入;(2)督導者穩定自我情緒、反思自我的移情與反移情,有利尋求不同改變的思維與行動,開啟對平行歷程的意識;(3)覺察受督者與督導者本身的非典型和不一致行為,能探尋到諮商關係與督導關系的相似性,進而

辨悉平行歷程現象。3. 督導者介入平行歷程的考量與介入歷程:(1)先進行自我情緒調節,以安頓自我;(2)聚焦了解和評估受督者的狀態,並促進受督者覺察;(3)聚焦督導關係的介入,以進行督導工作的澄清和討論;(4)針對諮商工作陷入困境的受督者,督導者會聚焦個案狀態和諮商關係的討論;(5)提供諮商策略,輔助受督者進行諮商介入;(6)在督導時除關照動力關係的微觀視框之外,增加系統間的宏觀視角;(7)最後,督導者也會將諮商介入的自主權交予受督者,尊重受督者的判斷和獨立性。4. 諮商督導者介入平行歷程的後續影響意義:(1)督導者介入平行歷程後,督導工作僵局得以解套,且透過督導的示範作用,協助受督者得以鬆動

人臉辨識技術(Facial Recognition Technology,以下簡稱FRT)在台灣於警務執法應用上,已相當普遍,但卻無一套規範,供執法機關作為執行依據;而司法者在現行法體系的解釋下,對於FRT之執法應用所應權衡之社會安全與隱私保護價值,因尚無此類案件繫屬於法院,故針對警方運用FRT為偵查工具之適法性判斷,恐仍欠缺相關意識。而FRT之運用,涉及個人高度隱私期待利益,有建立規範保護之必要,但究竟如何規範始為妥適?個人隱私利益與科技偵查技術發展之間孰輕孰重?如何權衡?個人得否抗衡國家執法機關以FRT配合其他政府資料庫的資訊使用於刑事案件辨識查找確認人別?國家機關是否得施以無合理嫌疑(

Reasonable Suspicion)或相當理由(Probable Cause)之FRT監控?當國家偵查技術之精進發展,有助打擊犯罪,維護社會安全,但當偵查技術之發展與個人隱私保護利益發生巨大衝突,司法機關應如何取捨?如何調和此兩種利益?上述問題在FRT已大量使用於警務系統之我國,未見系統性探討與提出解決方案。本研究擬針對上述問題提出若干可供思考的論述方向。承上,本文擬嘗試以美國聯邦憲法增修條文第四條(以下簡稱「美憲增修第四條」)演繹出的實務判解為框架,於第一章先說明本文研究動機、目的、範圍、限制、研究方法與鋪陳架構;第二章就FRT相關的技術原理以及廣泛使用下可能產生的隱憂,作一簡要說明;

第三章就美憲增修第四條下有關搜索(Search)的理論發展及規範內容作一概述;第四章係針對有關執法部門在公共場所取用FRT所得之人臉資料,藉此得知個人身分及位置資訊等作為,配合相關美國聯邦最高法院(以下簡稱「聯邦最高法院」)及下級法院有關判例、判決為說明,試圖建構出FRT執法應用在憲法適法性的定位探討,並初嘗從社會學理論之觀點,探尋合理隱私期待的界線與範圍,復探求制憲者於修訂美憲增修第四條時的意圖,以為認定合理隱私期待的一些指引方針;第五章提出包括華盛頓州州法、華盛頓州轄區內的金郡自治條例,以及國會審議中的相關聯邦法案(草案),規範有關政府部門使用FRT的相關內容作分析比較;第六章由探討FRT

的使用在我國現行法制下的適用可能性,藉此檢視現行法欠缺之現狀,說明建立制度規範的必要性,再以前開比較法作為基礎,提供可行的立法參考方向,並以從事司法實務的角度,對偵查目的下以FRT取用人臉影像資料,在解釋論上提出可能的解方;第七章則係針對本文提出結論,並期許在不久未來,偵查目的下的FRT取用,相關的法律規範能夠儘速完善建制出來。
