        筆者從小時候看著父親作畫,一直到自己成長迄今,回歸對藝術的探討,感受內心對藝術的悸動。藝術的路途是一種艱辛磨練,一種自我挑戰,是一種自我肯定的過程。對於筆者而言它是生命裡的一部分,是回憶的一部分,是未來希望的一部分。         個人的藝術創作形式是經由「偶發」到「實現」。「偶發」裡面包含著「即興─不可預見性」與「異想」。這可能讓創作者意識到當代任何的藝術創作是不能被事先決定的,也就是說藝術創作是不可預見的,純粹的藝術是即興的發揮,其淵源於內心的生機,也就是「內在生命」與「內在驅力」。藝術創作是絕對的自由,筆者嘗試著通過各種的形式與色彩來作為內心異想的表達,靠著不同的藝術

假新聞並非是近來才出現的產物,早在19世紀就有為獲取廣告收益不惜造假的「月亮大騙局」。隨著網路快速發展,社群媒體普遍應用,具有政治或選舉目的之假新聞在網路上大量的散播,少數國家甚至透過假新聞干涉其它國家的選舉,對於國家安全與民主政治也產生重大威脅。加上社群媒體演算法所計算形成的「過濾泡泡」,精準投放使用者閱讀喜好,加深了彼此偏誤,造成社會對立日趨嚴重。各國也意識到其嚴重性紛紛開始思索如何建制規範,惟言論自由乃係一民主國家最重要的基石,如何規範則成為各國面臨的新課題。以美國與德國兩國,兩者分別於2016年前後遭受假新聞的攻擊,政府與社會均受到嚴重的衝擊,但兩國因民主政體在看待言論自由的差異,發

展出不同的管制模式。故本文以美國「自由主義民主」與德國「防禦示民主」作為比較框架,用來分析在不同民主政體的下對於社群媒體管制模式是否有所差異。本文透過美國憲法起源來探討第一修正案對於言論的保障,以及《通訊端正法》的沿革,描繪現行美國未課予社群媒體針對平台上假新聞審查的責任,惟隨假新聞傳播猖獗更甚以往,民眾紛紛轉向要求社群媒體須肩負責任,在龐大的社會壓力下,社群媒體被迫更改平台機制,移除或阻擋平台上假新聞,但因其屬自律模式,目前處於各自為政的狀態。反觀德國因對於歷史的反思,為能有效督促社群媒體肩負社會責任,透過《社交網路強制法》,賦予主管機關裁處的權力,明確社群媒體履行義務的責任。由上述可知,美

國自由主義政體建構在強烈的個人主義上,在社群媒體管制上,優先以非政府管制為手段。而德國則是對於二戰歷史的反思所建構的防禦型民主政體,體會到任何自由與權利都須有界限,在一定條件下,可透過立法來規範,故於2017年通過《社交網路強制法》課予社群媒體管制平台上言論的義務。
