出生後的第一年為肢體與大腦發展最為迅速的時段,選擇適當的玩具產品能有效幫助嬰兒接收與反應環境中的刺激,進而促進其語言、情緒、空間與邏輯推理等認知能力。在眾多的嬰兒探索性玩具產品選項中,健力架為最常見且包含最多探索性物件,並能配合嬰兒初期成長使用之玩具產品之一。本研究以爬梳嬰兒認知與肢體發展理論,匯集家長第一手觀察嬰兒遊戲行為與市售健力架產品之比較分析,並納入認知神經科學之理論,旨在發展出健力架玩具產品設計之前置研究以提供未來玩具設計師及/或家長選購健力架產品之參考依據。本論文之研究問題為(1)父母為促進嬰兒大腦發展使用之探索玩具為何?(2)坊間健力架與嬰兒認知發展理論之關聯為何?(3)提出符

專利制度是知識經濟時代最為重要的一種智慧財產形式。在可專利的三要件中,以判斷發明是否顯而易見最為困難。其困難點在於判斷的規則無法具體化,以致於結果往往過於主觀。本文的研究目的是希望能由分析美國法院判決中對進步性判斷的見解,使審查基準的進步性要件能更易理解。本文之研究方法為:(1)案例研究法:以美國專利審查程序手冊(Manual of Patent Examining Procedure,以下簡稱MPEP)中有關顯而易見性之判決以及近年美國聯邦巡迴上訴法院有關顯而易見性之判決為對象。(2)文獻分析法:蒐集並整理與進步性相關之國內外期刊、文章、書籍及學位論文等文獻資料,並參考近年的網路相關文章為

輔,進而加以分析瞭解國內外對本研究之見解。因我國行政審查與法院判決在「發明所屬技術領域中具有通常知識者之技術水準」與「該領域具有通常知識者參考先前技術以及申請時的通常知識能否輕易完成系爭發明的整體」這兩步驟的論證相較美國欠缺,使達成進步性之心證揭露程度不足。本文研究結果建議以多件證據或欲解決之問題或先前技術所沒有之功效佐證結合理由,並藉由詳述先前技術範圍使具有通常知識者之技術水準具體化,使判斷進步性的灰色空間更明朗。
