海上定期運送服務係指，由航運公司或船舶經營者提供依據固定、預先公布的航程表、沿著特定航線營運，並停靠指定的港口，通常以貨櫃船作為提供運送服務之方式並承載相對高價值之貨物。為提供託運人所需的多樣化服務，運送人必須提供足夠頻率的船期以供託運人使用。海上定期運送的本質通常意味著消費者每週需要穩定的運量水準，然運量需求可能受季節波動影響，再加上船舶大型化的趨勢，很難使船舶運量的供給需求相符合，因此運送人間之合作乃屬必要。海運同盟(Shipping Conference)乃是定期航運市場之重要組織，且對於競爭結構有重大影響。為發展航運業，聯合國曾制定海運同盟行為準則公約，且歐盟亦於第4056/86號規
則給予海運同盟豁免競爭法之集體豁免地位。然因海運同盟具備「惡性卡特爾」之特性，屬嚴重限制競爭的作法，其與歐洲聯盟運作條約第101條及第102條規定相違背。由於第4056/86號規則與歐洲聯盟運作條約第101條及第102條並不相容，因此歐盟理事會通過第1419/2006號規則廢止第4056/86號規則。於廢除第4056/86號規則後，航運公司透過船舶共享協議提供聯合服務。然而，船舶共享協議亦可能違反歐洲聯盟運作條約第101條及第102條之規定，故歐盟執委會通過航運組合集體豁免條例，授予航運組合（Consortia）集體豁免權，使其不受歐洲聯盟運作條約第101條第1款的限制，然該條例將於2020年
