預售屋的商業模式可溯源於民國六十年十月,由台北房屋所成立,銷售位於敦南SOGO附近之宜家大廈,此為台灣當時預售屋銷售之首例,締造七天完銷的傳奇,而在宜家大廈這個案子更早之前,華美建設創辦人張克東就曾採用「預付訂金」的方式銷售房屋,後來芝麻酒店一案利用大眾集資方式,過於取巧的高槓桿模式終究以失敗收場,至今芝麻酒店因產權複雜,雖然不乏開發商試圖整合規劃,然而在2020年中旬,所有權人提出撤銷同意,都更計畫卡關,雖然當時的臺北市政府更新處要求實施者妥予溝通協調,但是談了1年還是走向分手,都更案正式破局,直至目前為止仍是一棟荒廢的大樓。據此可見,預售屋的買賣模式所存在之問題與風險,最終可能導致之後果

,並非短期之內可以妥善處理。我國預售屋履約保證機制屢經多次修正,目前將「履約保證機制」名稱修正為「履約擔保機制」,以符合消費者保護法第17條第2項第3款之規定,然實務上是否能對開發商或建商更進一步約束其預售屋之銷售方式,並且有效保障預售屋買受人之權益,似乎仍待時間檢視。本文研究目的在探討預售屋履約擔保機制所涉及之問題,首先對其預售屋履約擔保機制發展沿革,透過先進之文章進行歸納整理,其次為預售屋買賣契約之法律關係以及保證契約、擔保契約之區分加以說明,再以該機制現行各項規範、相關問題及續建機制之實務進行研究,最後為結論與建議,希冀本文對實務問題之探索,在未來消費者於購買預售屋時能有所助益,以確實保

  本研究透過文獻回顧及資料蒐集,整理出文化創意及文創產業、飲食文化、導入與發展等相關文獻,設計出訪談大綱,藉由質性研究方法中的訪談法,探討印尼飲食文化之導入與發展在臺灣之情形,並針對訪談資料及蒐集文獻進行整理與分析。  研究結果顯示印尼料理因貿易商導入印尼香料,如薑黃、香茅、沙嗲醬、胡椒、檸檬葉、花生粉等,食品如泡麵、蝦餅、巧克力、餅乾等,以上都是消費者很喜歡的食材及食品,消費者並且可以馬上回答的印尼香料及食品,而現在,印尼的食品在臺灣都可以買得到,只是水果沒有。而推廣印尼料理及食品主要直接經過印尼商店推廣,消費者表示,幾乎都是直接至印尼商店購買印尼料理及食品,另外在嘉義縣民雄鄉的齊普超市

、全省量販店如全聯社、家樂福、網路平臺,也可以買得到印尼商品。印尼店經營者銷售對象,包括從印尼嫁過來臺灣的新住民、陪同新住民來店的老公、跟新住民媽媽一起來的新住民二代、中國大陸來臺人士、印尼的移工如監護工、工廠的移工等,而印尼店的主要客人中,移工約占有7至8成。其中印尼店銷售最好的商品是印尼泡麵,這也是一般臺灣人也很喜歡吃的印尼食品。  最後研究提出具體的建議,印尼店的經營者或服務人員須具備語言溝通能力、印尼店的價目表,能標示清楚明確、印尼料理的口味要道地,印尼店環境需要再乾淨一點,對於臺灣本地客人須調整口味,以吸引更多不同客人、在此提供後續研究者研究參考。
