司法案件中居家保母與嬰幼兒事故傷害之分析

社會變遷多數婦女走入職場，讓居家保母的需求增加，家長對於保母有更多的要求，但居家保母在家照顧過程中因疏忽或情緒不穩導致不當管教的意外事件，卻沒有因著居家保母系統管理與訓練而停止。因此本研究透過「司法院法學資料檢索系統」的判決書，針對民國100年1月1日至109年5月28日居家保母與嬰幼兒事故傷害之108筆案件進行分析，共有109位受害者與118位被告，其中被告有69位受傷、40位死亡。結果發現本研究受害者當中，男童多於女童；年齡為1歲(含)以下之嬰幼兒的比例最高；過程當中有哭泣的比例較多；案件中有七成是領有保母證照；高中以上的比例佔八成，學歷越高導致嬰幼兒死亡的比例越高；收托月費為2萬(含)

以下之案件最多；托育總時數長達24小時之案件比例最高，與受害者是否死亡存在顯著性關聯，托育時間越長意外傷害越容易發生；而被告照顧嬰幼兒1個月到6個月(含)導致受傷與死亡率較高；案件最多發生於早上9:00-11:59之間，且於室內的臥室的受傷與死亡案件比例較高，其中於睡眠中死亡之案件較多，更要多留意；發生現場有第三個人在場的案件較多；被告收托2位以下嬰幼兒發生事故的機率較高。判決結果118位被告當中共有64位(54.2%)被處有期徒刑，有40位被判刑11個月以下之有徒刑；有13人遭處拘役，遭處50天拘役的比例最多；有28人緩刑，予以緩刑之案件73.1%被判刑11個月以下有期徒刑；有13筆案件有支

付和解金，其最低一萬元，最高金額達四百五十萬元。
