This thesis constitutes a comparison of attitudes toward online dating among German and Taiwanese graduate students in their twenties. Existing research points toward a simultaneously growing number of online daters and single people. The inherent mechanics of online dating apps and services have b
een observed to encourage certain behaviors in a majority of users, implying the existence of an online dating culture. In this thesis, the manifestations of this online dating culture are investigated using the example of German and Taiwanese graduate students. 18 participants with experience in on
line dating were divided by nationality and gender and interviewed in four focus group sessions. The results indicate that Taiwanese graduate students have a more positive stance toward online dating overall and are more likely than German graduate students to consider it a viable way of finding a l
ong-term partner. Participants of all genders and nationalities are undecided about marriage and children, citing personal freedom and the financial burden as reasons. Despite rising individualism worldwide, the two cultures still show clear signs of their basic orientation; the social perception of
their relationship is expressly more important to the Taiwanese than to the Germans, who see a relationship more as a means of self-actualization. This thesis makes an important contribution to the thus far rather limited scientific literature on online dating behavior in East Asia. The findings su
ggest that among young adults from both East Asian and Western cultures there is uncertainty about their own dating goals and their personal future prospects.

限制旅客飛行權利正當性之探討——以旅客「黑名單」為例

近幾年，隨著機上不循規行為日漸登上各國新聞版面，及該行為帶來之負面影響，社會上已出現討論是否應將行為不軌旅客列入航空公司禁止乘機之名單，亦即所謂「旅客黑名單」。惟航空公司為承載公共運輸職能之主體，是否得任意建制旅客黑名單拒絕載運旅客？此涉及航空公司是否具備強制締約義務。若認為航空公司具有強制締約義務，航空公司原則上即不得拒絕與旅客訂定運輸契約，遑論以建立旅客黑名單之形式概括拒絕締結契約；惟若認為航空公司不具有強制締約義務，則航空公司享有契約自由，得自由決定是否與旅客締結契約。 但無論如何，實務上確實存在旅客黑名單機制。而被航空公司列入旅客黑名單之旅客，無法搭乘航空公司之航班，此
即涉及限制旅客之遷徙自由權等權利。又在肯認憲法「第三人效力理論」之前提下，私主體得對另一私主體主張憲法上之權利，故航空公司基於契約自由所建制之旅客黑名單限制旅客之遷徙自由權，是否有過度之嫌而侵害旅客之遷徙自由權，即有探討之空間與必要。換言之，航空公司建制旅客黑名單是否具備正當性，實值討論。 此外，使旅客無法搭乘航空器之所謂「黑名單」，除航空公司實務上有此機制外，尚有國家以高權形式禁止人民搭乘航空器，此為較容易被忽略之「禁飛名單」（No Fly List）。既然人民因國家之行為無法搭乘航空器，涉及限制其諸多權利，則該制度（禁飛名單）是否具正當性亦值得探討。因此，本論文擬就禁止旅客搭乘航空器
